Workers' compensation claims rarely exist in isolation. When an injured worker is also facing time off, an ADA issue, or another overlapping claim, competing statutes complicate settlement negotiations and release strategy. Professor Michael C. Duff, Saint Louis University School of Law, examines how to approach adjuster conversations, evaluate the true scope of what is being settled, and identify which claims cannot be released.
