However, it "threw out the $464 million in damages," citing the Eighth Amendment's excessive fine provision. The decision was a "brokered outcome," with judges divided on a new trial vs. vacating the financial penalty. A dissenting judge, David Friedman, openly suggested the case should not have been brought, claiming "everyone does it" and that the AG acted for "partisan political purposes," which is "unheard of, and demeans both his position and hers."
