Notas del episodio
From The Kugel Law Firm - What Is a Field Sobriety Test in New York? explores how field sobriety tests are used during traffic stops and DWI cases across New York, Manhattan, and New York City. The episode explains the role of Standardized Field Sobriety Tests, including the Horizontal Gaze Nystagmus, Walk-and-Turn, and One-Leg Stand tests developed by the National Highway Traffic Safety Administration.
Listeners will learn whether drivers in New York can refuse field sobriety tests, how these roadside exercises differ from chemical tests under VTL § 1194, and why refusal may still be discussed in court. The discussion also covers DWI charges under VTL Section 1192, probable cause, BAC evidence, and how prosecutors may use test performance in a Driving While Intoxicated case.
The episode highlights Rachel Kugel of The Kugel Law Firm, a Manhattan DWI defense attorney who handles DWI and DUI matters throughout New York and New Jersey. It also reviews factors that can affect test results, including medical conditions, environmental conditions, nervousness, footwear, lighting, road surfaces, and officer training.
This podcast also explains how defense attorneys may challenge field sobriety test evidence using NHTSA protocols, body camera footage, dashcam recordings, officer qualifications, and testing conditions. The Kugel Law Firm serves clients in Manhattan, Harlem, the Bronx, Brooklyn, Queens, and surrounding areas, including cases handled at New York County Criminal Court.
